Britton, brings this appeal from an action instituted by plaintiffs-appellees, the City and County of Denver, et al., pursuant to C.R.C.P. 106(a)(4), in which the district court held that the Civil Service Commission (Commission) had usurped its jurisdiction and abused its discretion in directing that Lieutenant Britton be promoted to the rank of Captain in the Denver Police Department (Department). We affirm.
